PAYE (Income Tax)

South Africa PAYE rates range from 18% (on taxable income up to ZAR 237,100) to 45% (above ZAR 1,817,000) for the 2024/25 tax year, under the Income Tax Act. Monthly PAYE is calculated, deducted, and submitted to SARS via EMP201 returns by Atlass Partners.

UIF (Unemployment Insurance Fund)

Employer UIF contribution: 1% of gross salary. Employee UIF contribution: 1%. Total 2% monthly (capped), remitted to SARS alongside PAYE. Provides unemployment, illness, maternity, and dependant benefits. Atlass Partners manages UIF registration and monthly remittance.

SDL (Skills Development Levy)

Employer contribution of 1% of gross monthly payroll for organisations with annual payroll above ZAR 500,000 — remitted monthly to SARS, funding skills development under the Skills Development Act. Atlass Partners manages SDL compliance for all qualifying EOR engagements.

BCEA (Basic Conditions of Employment)

BCEA sets minimum conditions: 15 days annual leave per cycle (after 12 months), extended sick leave provisions, 4 months unpaid maternity leave (or paid under UIF), 3 days family responsibility leave, and a maximum 45-hour working week.

Employment Equity (EE)

Designated employers (50+ employees or above turnover threshold) must submit annual Employment Equity reports to the Department of Employment and Labour. Atlass Partners advises on EE obligations for EOR engagements and supports EE reporting requirements.

Labour Relations Act (LRA)

The LRA governs unfair dismissal, collective bargaining, and dispute resolution through the CCMA. Atlass Partners ensures all EOR employment contracts and termination processes are fully LRA-compliant, including substantively and procedurally fair dismissal requirements.
